Types of POA

What each power of attorney does

The document required depends on what the attorney will do. Dubai Courts asks for a different supporting document for each type.

✓ Company or establishment POA — Lets the attorney act for a company, for example signing the MOA, signing before the notary, or opening and operating bank accounts. The trade licence is uploaded with the application.
✓ Property POA — Covers acts over a named property. The title deed is required as the supporting document.
✓ Trademark POA — Authorises the attorney to act on a registered trademark. The registration certificate is required.
✓ Vehicle POA — Authorises acts over a vehicle. The ownership certificate is required.
✓ Inheritance POA — Used in estate matters. A determination of heirs or a death certificate is required.
✓ General POA at Dubai Courts — A separate Dubai Courts product with its own conditions: the principal must be a national partner in a commercial licence, principal and agent attend in person, and the POA must expressly exclude acting on government-granted land.

Remote execution

Signing without attending in person

Dubai Courts runs a Smart Electronic Notary for POAs, acknowledgments and legal warnings, under Federal Decree-Law No. 20 of 2022, which permits notaries to conduct transactions electronically without the physical presence of the parties.

✓ AED 100 per signature — The attestation fee is stated as AED 100 for each signature of the parties to the POA. Applications are accepted 24/7 and audited during official working hours.
✓ Open to non-residents — The service page accepts an Emirates ID or a passport in PDF, and states it is available to all legal and moral persons. A non-resident can create a UAE Pass Visitor account on a passport.
✓ Signature by OTP — Parties are identified and sign electronically by OTP. If the document is amended, a new OTP is sent. We never enter a client's OTP or password.
✓ Presence decided by the system — The system routes the file and decides whether it needs auditing without the parties present, or with their virtual or personal presence. The certified document is delivered by email.
✓ Arabic and age conditions — All documents must be legally translated into Arabic and attested by the Ministry of Justice. The applicant or representative must be 21; younger means a guardian, trustee or curator acts.
✓ Channels — Individual Dubai Courts accounts, private notaries, public notaries, authorised government employees, law firms and government service centres.

Execution from abroad

Signing outside the UAE

Where a client cannot register with a UAE notary, or the POA must be executed under their own law, the document is signed abroad and legalised into the UAE. MOFA attestation fees below are authority fees.

Common Questions.

For a POA executed in the UAE, Dubai Courts charges AED 100 per party plus an AED 20 Knowledge and Innovation fee, so a single-signatory POA is about AED 120 in government fees. Through the Smart Electronic Notary the fee is AED 100 for each signature. Drafting, Arabic legal translation and any service charge sit on top of that. Advertised all-in market packages run from about AED 599 to AED 1,800 depending on scope and translation.
Yes, in two ways. Dubai Courts' Smart Electronic Notary accepts a passport in PDF, identifies parties by OTP, and can hold attendance virtually, at AED 100 per signature. Alternatively you sign before a notary or solicitor in your own country and legalise the document into the UAE through that country's foreign ministry, the UAE Embassy and UAE MOFA.
MOFA classifies the document. A POA of a personal nature is an Individual Affairs Document at AED 150, while a POA containing any commercial content is a Commercial Document at AED 2,000. Any commercial content is a low bar: opening a company bank account, signing a trade licence, transferring shares or representing an establishment all cross it. Where the matter genuinely is personal, keeping company references out of the drafting saves AED 1,850.
Narrow reading of scope is the main cause. UAE authorities will not accept wording such as to do all necessary acts as authority to open a bank account. The acts must be named, for example sign the MOA, sign before the notary, open and operate bank accounts, sign the tenancy, apply to the licensing authority and receive the trade licence. Names and numbers of the principal and attorney must match the passport or Emirates ID exactly.
State a validity period in the document. Some authorities require a POA issued within a recent window, so an older instrument may be refused even if it has not expired. A POA otherwise runs until it is revoked. Confirm the required wording and window with the receiving authority before drafting.
Revocation is its own notarised transaction, not a letter. The attorney and the relevant authorities are notified. Ministry of Justice cancellation of contracts and deeds is AED 200 in federal jurisdictions, and DIFC Courts prices cancellation of a POA at USD 100 for an individual and USD 250 for a corporation. A broad company POA left outstanding with a former consultant or partner leaves the principal exposed.
